Reasons for the Removal of Article 370
As per Article 370 of the Indian Constitution, Jammu Kashmir has a special status with a separate constitution, a state flag, and autonomy of internal administration. After Article 370, the status of the state of Jammu and Kashmir was changed to Union territory. Previously a princely state, Jammu and Kashmir became part of India after gaining its independence. In 1954, India took control of it as a state.
- Jammu and Kashmir are granted their own constitution, legislative autonomy, and separate flag in accordance with Article 370 of the Indian Constitution.
- Additionally, the central government continued to handle matters related to communication, defence, and foreign policy.
- As a result, the state is free to impose its own restrictions on property ownership, long-term residence, and basic rights.
- Prime Minister Narendra Modi and the Hindu nationalist Bharatiya Janta Party have consistently opposed Article 370 because it has resulted in a conflict between India and Pakistan (related to Kashmir).
- They call for the fusion of Kashmir with the rest of India.
- However, there have been numerous controversies as a result of this decision, leading many Kashmiris to believe that the government intended to alter the demographics of the state by allowing outsiders to purchase land there.
