Section 7 of the Prevention of Corruption Act 1988 mentions about “a public servant who shall accept any gratification other than lawful remuneration for an official act.” Provided that no person charged with an offence under the Prevention of Corruption Act, Samvat 2006 shall be released on bail unless the Public Prosecutor has been given an opportunity of being heard to oppose the bail application.

Section 7 in Prevention of Corruption Act

It states that whoever is or is expected to be a public servant, may, by way of reward or motive, for himself or any other person, other than legal remuneration, from any person, for himself or any other person agrees to or seeks to obtain or accept or obtain satisfaction or to show or

be aggrieved to officially do any act or
to show favour or
prejudicial to any person in the performance of his functions or
to render any service or favour to any person, the Central Government or any State Government or
for attempting to show or with the Parliament or the Legislature of any State or
any local authority, corporation, or Government company in clause (c) of section 2
or with any public officer, whether appointed or otherwise, shall be punished with imprisonment for a termwhich shall not be less than three years.

However, it can be extended up to seven years and also with a fine.
