What is Article 338 A?

Article 338 A specifies the need for a commission for India’s Scheduled Tribes. It specifies the establishment of a commission for Scheduled Tribes (ST), to be known as the National Commission for Scheduled Tribes (NCST). The NCST was brought into existence by making amends to Article 338 and including another Article 338A in the Constitution of India.

The former National Commission for Scheduled Castes and Scheduled Tribes was replaced by two independent commissions, the National Commission for Scheduled Tribes (NCST) and the National Commission for Scheduled Castes (NCSC).
The National Commission for the Scheduled Tribes was established by Article 338 A. Article 338 is concerned with the National Commission for Scheduled Castes (NCSC). The National Commission for Scheduled Tribes was tasked with overseeing the rights, welfare, and development of India’s Scheduled Tribes.
The following are some of the responsibilities:
- To look into the matters relating to the complaints where any of these Scheduled Tribes are being deprived of their basic rights.
- To ensure their safety and security.
- Make recommendations with respect to the steps that need to be taken with the view to the protection and socio-economic development of these Scheduled Tribes (ST).
