How Many Maximum Judges Should be there in the Supreme Court?

A total of 34 judges (including the Chief Justice of India) are there in the Supreme Court. In a letter dated 21 June 2019, the Chief Justice of India urged the government to take appropriate measures to increase the number of judges serving on the Supreme Court. As a result of this request, the Supreme Court of India’s sanctioned judges strength has increased from 30 to 33 (excluding the Chief Justice of India) w.e.f 9 August 2019.

Maximum Judges in the Supreme Court
The strength of judges was increased from 25 to 30 by the Supreme Court (Number of Judges) Amendment Act, 2009. Later in 2019, another request by the CJI led to another revision in the strength of supreme court judges. Hence, the maximum number of judges that should be there in the Supreme Court has become 33 following the passage of the Supreme Court (Number of Judges) Amendment Bill, 2019.
- However, the Act caps the number of Supreme Court justices at 30. (excluding the Chief Justice of India).
- In light of this, the President of India may appoint no more than one Chief Justice and 30 additional judges to the Supreme Court of India.

Functions of the Supreme Court of India

- It also resolves conflicts involving the federal and state governments.
- The SC may also bring legal challenges on its own.
- The Union government, state governments, and all Indian courts must abide by the Supreme Court’s decision regarding the law.
