1. 'You Must Protect The Institution From Targeted, Motivated And Mala Fide Attack': CJI Ramana's Advice For Young Lawyers

  • Chief Justice of India NV Ramana on Saturday remarked that young lawyers must strive to protect the integrity and reputation of the judiciary. He was speaking at an event organised by the Bar Council of India (BCI) to felicitate him. The event was held in the presence of Supreme Court judges, Union Law Minister Kiren Rijiju and other top law officers.

  • "I also want to use this platform to send a message to the young members of the Bar. Never forget the age old values of this noble profession..respect the institution and the judges. You are the frontline of the legal system, and you must protect the institution from targeted, motivated and mala fide attacks. It is inherent to the Bar that it speaks up for what is fair and just", the CJI stated.

  • "Never forget the age old values of this noble profession. Seniority has immense value in this profession. Give due regards to your seniors at the Bar for their experience, knowledge and wisdom. Respect women colleagues and treat them with dignity"

  • CJI Ramana further opined that lawyers are born leaders and that they should always remain active members of the society and solve problems faced by the people.

  • "A lawyer needs to be an all-rounder and a versatile personality. He must be well versed about social issues and various fields like economics, history, politics, literature and others. Here we must remember lawyers such as the legendary Mr. Nani Palkhivala, who despite never being an economist, used to address the public every year regarding the Budget"

  • CJI Ramana observed that there seems to be a new trend in the profession akin to what happens in foreign jurisdictions. He opined that there is rampant 'corporatisation of the profession.'

  • "Because of issues relating to livelihood, many young and bright lawyers are joining law firms. This is a welcome change, as it is opening up fresh avenues for first generation lawyers. But at the same time, it is also causing a decline in the traditional practise. Common people cannot afford quality legal advice at corporate prices which is an area of concern", the CJI stated.

2. CBSE Compartment, Private & Patrachar Students Can Take Provisional Admissions Before Results : Supreme Court

  • The Supreme Court clarified that the students appearing for CBSE Private, Patrachar and 2nd Compartment exams for Class 12 can apply for higher admissions under the UGC and AICTE provisionally even before their results are declared, subject to undertaking to produce their results before the concerned college within one week of the declaration of results.

  • The Court passed this order based on the submissions made by the counsels of UGC and AICTE that such students can make provisional applications for admissions.

  • The Court also recorded the undertaking made by the counsel of CBSE that the results will be declared before September 30.

  • A Bench comprising Justice AM Khanwilkar, Justice Hrishikesh Roy and Justice CT Ravikumar was hearing a writ petition filed seeking directions to CBSE to declare results of Class XII Private Patrachar/2nd Compartment Students expeditiously.

  • Advocate Anjaneya Mishra, appearing for the petitioner, submitted that nearly one lakh students are taking the 2nd Compartment, Private and Patrachar exams. He added that many admissions to colleges have already opened and hence the petitioners are apprehensive of losing out seats before the declaration of their results.

  • Based on the submissions made on behalf of UGC and AICTE, the bench dictated the following order : "The principal grievance of petitioners is that CBSE may delay announcing of results of Class XII Private, Patrachar & 2nd Compartment Students resultantly denying them admission for higher studies. The counsel for CBSE on instructions stated that results of all students including Private, Patrachar & 2nd Compartment Students will be declared before 30 September as undertaken before this Court on an earlier occasion. That position is reiterated & recorded.

  • Counsel for UGC pointed out even if results are not available and admission process for higher studies commences before 30 September, the petitioners and similarly situated studednts can apply for admission on provisional basis subject to producing the results declared by CBSE on or before 30 September.

  • The Counsel for AICTE submits that petitioners will be permitted provisional admission subject to producing results declared by CBSE.

3. Supreme Court Collegium Recommends 68 Names As Judges For 12 High Courts; 12 Names Reiterated

  • Signifying a proactive intent to fill up the mounting vacancies in the High Courts, the Supreme Court collegium has recommended to the Central Government 68 names for elevation as judges of 12 High Courts across the country.

  • A 3-member collegium comprising the Chief Justice of India NV Ramana, Justice UU Lalit and Justice AM Khanwilkar cleared the names in the meetings held on August 24 and September 1. The statements regarding the recommendations were uploaded in the official website of the Supreme Court yesterday night.

  • The recommendations will become final if accepted by the Central Government. Out of the 68 names, 12 names are reiterations, which include 9 advocates and 3 judicial officers for 5 High Courts. These names were earlier returned to the collegium for reconsideration by the Union Ministry of Law and Justice.

  • The recommendations have been made or the High Courts of Allahabad, Madhya Pradesh, Rajasthan, Punjab & Haryana, Calcutta, Jharkhand, Chhattisgarh, Gauhati, Karnataka, Madras, Kerala and Jammu & Kashmir High Courts.

  • The maximum recommendations have been made for the Allahabad High Court. The names of 13 advocates have been proposed and the names of 3 judicial officers have been reiterated for the Allahabad High Court. 10 names have been proposed for Calcutta High Court and 8 for the Kerala High Court.

  • 44 of the total names recommended are advocates and 24 are judicial officers. As per the latest statistics, the High Courts have 465 vacancies against a total strength of 1089 judges. Separate reports about the names proposed for High Courts may be read below:

  10. Karnataka (2 names reiterated)

  11. Madras(4 names proposed)

  12. Kerala(8 names proposed)
