What is Article 42?

Article 42 stands for just and humane working conditions and maternity relief. “The State shall make provision for securing humane conditions of work and for maternity relief”. Article 42 is dedicated to the fulfillment of the economic and social welfare of the people, and aims to establish India as a welfare state.

Considering the fact that the majority of India’s population is poor, many people find work in low-paying sectors with low-quality work environments. These conditions are not human at all and cause many accidents. Additionally, women employees were often fired from their jobs while they were on maternity leave. This made it difficult for women to keep their jobs and grow in their careers. Hence, provisions for a just and empathetic working environment were the need of the hour.

  • In order to ensure that the state changes its casual attitude towards its employees, Article 42 was brought to life.
  • According to Article 42, the Constitution of India states that the State shall make provisions for ensuring humane conditions of work and maternity relief.
