Regulation of GI Tags in India
Geographical Indication tags are a part of the Intellectual Property Rights (IPRs) as guided by the Paris Convention for the Protection of Industrial Property. Owing to the origin of GIs, they are regulated on different levels;
- On an international level, GI tags are overseen by the World Trade Organisation’s agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
- On a domestic level, GI tag and their registrations are administered under the Geographical Indications of Goods (Registration and Protection) Act, 1999 which came into effect on the 15th of September 2003.
- The product from West Bengal, Darjeeling Tea, was accorded the first GI tag in India in the year 2004-05.
Protection of GI Tags
A wide roster of approaches ensures the protection and preservation of GI tags in different national and regional systems. These approaches can be consolidated with one another to do their job. Three major ways to protect a geographical indication are;
- Special regimes of protection (sui generis systems)
- Collective/certification marks
- Techniques like the administrative product and approval schemes for concentrating on business practices.
Over time, these approaches have developed in accordance with varying legal practices and with different historical and economic circumstances in mind.
Importance of GI Tags
Geographical Indication (GI) tags are a type of intellectual property that identifies a product as originating from a particular geographical location or region in India. GI Tags hold significant importance in India for various reasons:
- GI tags help protect traditional knowledge and cultural heritage associated with a product, and ensure that the benefits of such knowledge go to the communities who have preserved it over generations.
- GI tags assure customers of the authenticity and quality of the product.
- GI tags help farmers and artisans in rural areas to get recognition for their products and earn better livelihoods.
- GI tags also promote tourism by creating awareness and interest in unique local products and attracting tourists to visit the places of origin.
- GI tags provide national and international recognition to products that are unique to India, contributing to the country’s branding and image all over the world.
Therefore, GI tags play an essential role in preserving and promoting India’s traditional and unique products and provide social benefits to the communities involved in their manufacturing.
