The Supreme Court collegium has recommended nine names to the Centre for appointment as judges in the court. Justice BV Nagarathna, who is among three women recommended for the post, is in line to become the first woman Chief Justice of India.

  • On Tuesday, the Supreme Court Collegium recommended nine names, including three women, to the Centre for appointment as judges.

  • The Supreme Court collegium, headed by Chief Justice of India (CJI) NV Ramana, has cleared nine names for appointment as judges in the court.

  • Justice BV Nagarathna, currently a judge in the Karnataka High Court, is in line to become the first woman Chief Justice of India (CJI) in 2027 if the government clears her name for appointment.

  • The collegium is believed to have ended the nearly two-year-long logjam by recommending the names of nine judges to the Centre.

  • The five-member collegium, which also comprises Justices UU Lalit, AM Khanwilkar, DY Chandrachud and L Nageswara Rao, has sent three names of woman judges, including Justice BV Nagarathna from the Karnataka High Court who could become the first woman CJI.

HERE ARE THE NAMES OF 9 JUDGES:

1) Justice Hima Kohli: Chief Justice of Telangana

2) Justice BV Nagarathna: Judge of Karnataka High Court -- likely to become India's first Woman CJI if her name is cleared immediately

3) Justice Bela Trivedi: Judge of Gujarat High Court

4) Senior Advocate PS Narasimha: Direct elevation from the Bar -- 9th such elevation directly from the Bar

5) Justice Abhay Shreeniwas Oka: Chief Justice of Karnataka High Court

6) Justice Vikram Nath: Chief Justice of Gujarat High Court

7) Justice Jitendra Kumar Maheshwari: Chief Justice of Sikkim High Court

8) Justice CT Ravikumar: Judge of Kerala High Court

9) Justice MM Sundresh: Judge of Madaras High Court

  • Nine vacancies in the Supreme Court fell vacant after Justice RF Nariman retired on August 12. With his retirement, the strength of judges in the Supreme Court has come down to 25 as against the sanctioned strength of 34, including the CJI.

  • The recommendations, if accepted, will fill all current vacancies taking the working strength to 33.

  • One additional vacancy would arise today when Justice Navin Sinha retires.

Women in judiciary

  • If Nagarathna becomes the first woman Chief Justice of India, it will be a historic moment for the country’s judiciary. There have been demands to have a woman Chief Justice in India.

  • Currently, the top court has only one woman judge, Justice Indira Banerjee, who is set to retire in September 2022. There have only been eight women judges appointed in the Supreme Court till date.

  • The Supreme Court Women Lawyers Association had said that the representation of women in the Supreme Court was “abysmally low”.

  • It said that only eight women judges have been appointed to the Supreme Court and there have been no woman Chief Justice of India.

  • The association’s plea said that out of 25 High Courts, only one has a woman as its chief justice. Hima Kohli is the Chief Justice of Telangana High Court.

  • In five High Courts – Patna, Manipur, Meghalaya, Tripura and Uttarakhand, there is not even a single woman judge.

About Justice BV Nagarathna

  • Justice BV Nagarathna was appointed as an Additional Judge of the High Court of Karnataka in 2008 and as a permanent judge nearly two years later.
  • If she becomes the CJI, she will be following in the footsteps of her father ES Venkataramiah, who was the Chief Justice of India between June 1989 and December 1989. 
  • In November 2009, she, along with two other judges of the Karnataka HC was locked in a court room by a group of protesting lawyers but she braved the situation in a dignified manner. She later said: “We are not angry, but we are sad that the Bar has done this to us. We have to hang our heads in shame.”
