All About Appointment of CBI Director

The Appointment Committee of the Cabinet has appointed Subodh Kumar Jaiswal as the Director of Central Bureau of Investigation (CBI) for a period of 2 years from the date of assumption of charge.  The Central Bureau of Investigation (CBI) was working without a regular chief for over three months after Rishi Kumar Shukla completed his two-year tenure on February 3.He has been serving as the Director-General (DG of the Central Industrial Security Force (CISF).

  • He was recommended for the post by the 3-member selection committee led by Prime Minister Narendra Modi. The 3 members’ high-level Selection committee headed by PM consists of Chief Justice of India NV Ramana and Leader of Opposition in Lok Sabha Adhir Ranjan Chowdhury. 

Who is Subodh Jaiswal?

  • Subodh Jaiswal is a 1985-batch Maharashtra cadre IPS officer who was serving as the chief of CISF.
  • Earlier, he held the post of Mumbai Police Commissioner and Maharashtra DGP.
  • The 58-year old officer was the chief of the Special Investigation Team that probed the Rs 20,000 crore fake stamp paper scam also known as the Abdul Karim Telgi scam.
  • Subodh Jaiswal was awarded the President’s Police Medal for his distinguished service in 2009.

Appointment of CBI Director:

  • The Director of CBI as Inspector General of Police, Delhi Special Police Establishment, is the head and responsible for the administration of the Institution.
  • The Lokpal and Lokayuktas Act of 2013 amended the Delhi Special Police Establishment Act (1946) and made the below mentioned changes wrt appointment of the Director of CBI:
    • Structure of Appointment Committee: The Central Government shall appoint the Director of CBI on the recommendation of a three-member committee consisting of
      • Prime Minister as Chairperson
      • Leader of Opposition in the Lok Sabha and
      • Chief Justice of India or Judge of the Supreme Court (SC).
  • The Delhi Special Police Establishment (Amendment) Act, 2014 made a change in the sturcture of the committee.
    • If there is no recognized leader of opposition in the Lok Sabha, then the leader of the single largest opposition party in the Lok Sabha would be a member of that committee.
  • Term of CBI Director: The Director of CBI has been provided security of two-year tenure in office by the CVC Act, 2003.

About the Central Bureau of Investigation (CBI):

  • The CBI came into existance in 1963 by a resolution of the Ministry of Home Affairs.
    • Now, the CBI comes under the administrative control of the Department of Personnel and Training (DoPT) of the Ministry of Personnel, Public Grievances and Pensions.
  • Santhanam Committee on Prevention of Corruption (1962–1964) has recommended the establishment of CBI.
  • The CBI is not a statutory body, it derives powers from Delhi Special Police Establishment Act, 1946.

    • It is also the nodal police agency in India which coordinates investigations on behalf of Interpol Member countries.
  • The CBI has jurisdiction to investigate offences pertaining to 69 Central laws, 18 State Acts and 231 offences in the IPC.
