Article 21A, which reads in part: "The State shall offer free and compulsory education to all children of 6 to 14 years in such manner as the State, may by law determine," was added to the Indian Constitution by the 86th Constitutional Amendment (2002).

Act on the Right to Education

  • "The Right of Children to Free and Compulsory Education Act" is the official name of the legislation. In August 2009, the Parliament approved it. When the Act was enacted in 2010, India joined the list of 135 nations where every kid has the fundamental right to an education.
  • This resulted in removing the right to education from the Directive Principles of State Policy list and its inclusion as a Fundamental Right.
  • The 86th Amendment's resultant legislation is known as the RTE.
  • The title of the article includes the term "free." This means that no kid is required to pay any form of fee, charge, or expense that would prohibit him or her from pursuing and finishing elementary education, except those allowed by their parents into a school not financed by the government.
  • The government is now required by this Act to ensure that all children between the ages of six and fourteen be admitted, attended, and completed primary school.
  • In essence, this Act guarantees free basic education to all kids in socially and economically disadvantaged areas.
